1. Data Fiduciary & Controller
CreatorCanvas ("Company", "We") is the Data Fiduciary under the Digital Personal Data Protection Act, 2023 (India).
2. Introduction
Welcome to CreatorSuite (the "App"). We are committed to protecting your privacy.
3. Data We Collect
- Account Data: Name, Email (for Pro subscription management).
- AI "DNA Profile": User-defined brand voice, stylistic preferences, and specific content DNA used to personalize AI outputs.
- Payment Data: We do NOT store full card numbers or bank login credentials on our servers. Online transactions are processed through PCI-DSS compliant gateways (including Razorpay, Paytm, Dodo Payments for international subscriptions where applicable, or other processors we may use). You are responsible for a stable internet connection so your device can receive real-time payment confirmation from the gateway.
- Usage Data: We track AI feature usage to improve output quality.
- Advertising & optional promotional programs (when offered): If the App offers optional ads or bonus-credit offers for eligible accounts, we and third-party ad partners may process data as described in those partners' policies (for example advertising or device identifiers where applicable). We may log coarse events (such as that an ad was shown or completed, or that bonus credits were granted) to operate daily caps fairly, reduce misuse, and understand product usage. Paid subscribers are not required to use these optional offers.
4. AI & Content Ownership
- Your Inputs: Text/Images uploaded are processed by AI solely to generate results.
- Your Ownership: You own 100% of the intellectual property (scripts, captions, contracts) generated using this tool.
5. AI "DNA Profile" Protections & Encryption
- Strict Isolation: Your "DNA Profile" is protected by Row Level Security (RLS). No other user can view or access your specific stylistic data.
- Encryption: All DNA records are encrypted at rest using industry-standard AES-256 encryption within our Supabase production infrastructure.
- Data Preservation: DNA records are preserved in your secure database profile to ensure consistency in AI outputs. You may request deletion of this data at any time.
6. Purposes for Which We Use Personal Data
We process personal data to: provide and operate the Service; authenticate users; manage subscriptions, billing, invoices, and support; meter credits and prevent abuse; improve reliability and security; communicate service messages; comply with law; and, where offered, optional promotional or advertising programmes as described above.
7. How We Share Data and Processors
We do not sell your personal data. We share data with processors who help run the Serviceâmanaged cloud and database hosting, authentication, payment gateways (e.g. Razorpay, Paytm, Dodo Payments), email, analytics, and AI inference (e.g. Groq)âonly as needed. We may disclose information if required by law or to protect rights, safety, and security. If you use apps we publish through Google Play or the Apple App Store, the Data safety (Google) and App Privacy (Apple) information declared in those developer consoles must stay consistent with this Policy and with how the Service actually worksâthose declarations are in addition to this Policy.
8. Cookies and Similar Technologies
Our websites and web app may use cookies, local storage, or similar technologies for session authentication, preferences, essential security, and (where enabled) analytics or advertising partners. You may control cookies through your browser; blocking essential cookies may affect login.
9. Your Rights, Grievance Officer, and DPDP (India)
Where the Digital Personal Data Protection Act, 2023 applies, you may have rights to access, correction, erasure, nomination, and withdrawal of consent, subject to applicable exceptions. For data-protection requests and privacy complaints, contact the Grievance Officer at grievance@creatorsuiteai.org. For general product, billing, or account support, contact support@creatorsuiteai.org. Where the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 apply (as relevant), complaints may be directed to the same Grievance Officer email; we aim to acknowledge within 24 hours and dispose of the grievance within fifteen (15) days, subject to complexity and law. We do not publish a walk-in address for user support; redressal is by email. Regulators, law enforcement, and payment or distribution partners may use channels agreed in those regimes. You may have further recourse under law, including to the Data Protection Board of India when available.
10. Children
The Service is not directed at children under 18. We do not knowingly collect data from children. Contact grievance@creatorsuiteai.org if you believe we have, and we will take steps to delete it.
11. Third-Party Links
The Service may link to third-party sites; their practices are their own.
12. International Processing
Data may be processed in India and other countries where processors operate, with appropriate safeguards as required by law.
13. Account Closure and Data Deletion Requests
You may request account closure and deletion of personal data we hold by emailing grievance@creatorsuiteai.org (or support@creatorsuiteai.org for general account help). We respond in line with applicable law. We may retain certain information where law, tax, accounting, fraud prevention, payment-partner rules, or disputes require or permit retention. If you purchased through Google Play or the Apple App Store, those platforms may hold additional records under their policies.
14. Changes to This Privacy Policy
We may update this Policy; the "Last updated" notice will change. Continued use after posting may constitute notice where permitted; if you disagree, stop using the Service and contact support@creatorsuiteai.org or grievance@creatorsuiteai.org.
1. Nature of Service (The 'Tool' Clause)
CreatorSuite is an AI-powered software tool for information purposes only. We are NOT a law firm. The documents generated are drafts/templates and do not constitute legal advice.
2. Global Compliance
You agree to comply with all applicable local, state, and international laws. You are solely responsible for ensuring that any content generated via this App complies with the laws of your specific region.
3. Limitation of Liability
To the maximum extent permitted by law, CreatorCanvas, its Proprietor (Owner), and Affiliates shall NOT be liable for any direct, indirect, or consequential damages arising from errors, omissions, or missing clauses in generated documents. Total liability is limited to fees paid by you in the last 12 months.
The same overall liability ceiling applies, to the maximum extent permitted by applicable law, to your use of the Service generallyâincluding websites, software updates, availability or interruption, credit metering, integration with third-party platforms (including AI and payment processors), and AI model behaviourâwithout narrowing any stricter protection under mandatory consumer law.
4. Indemnification
You agree to indemnify and hold CreatorCanvas, its Proprietor (Owner) and Affiliates harmless from any third-party claims, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content or inputs, your publication or reliance on generated outputs, or your breach of these Terms.
5. Pricing & Subscription Terms
Since our services rely on third-party AI infrastructure costs, pricing is subject to change without prior notice. However, any active subscription will be honored at its original rate until the end of the current billing cycle. Future renewals and new subscriptions will be charged at the rates effective at the time of payment.
AI credits: Plans include a daily credit pool (shown in the app). Credits measure units of AI processing; they do not necessarily correspond one-to-one to outputs. Different features consume different credits per successful run. Unused credits reset per the schedule shown in the product.
Optional bonus credits (advertising). For eligible free or promotional accounts, the App may offer optional ways to earn bonus creditsâfor example, by choosing to view advertising (such as rewarded video). These offers are promotional only, are not part of any paid subscription you purchase, and are not guaranteed to be available at all times. The interface may describe a daily maximum using wording such as "up to" a stated number of rewarded views per day (for example, up to five). "Up to" means a ceiling; the actual number available may be lower on a given day. We may change, suspend, or end these promotions, or adjust daily limits and credits earned per actionâincluding to address misuse, abuse, automation, or operational reasonsâwithout owing you compensation for benefits you did not pay for. Changes to promotional or bonus credits do not reduce what you are entitled to under a paid plan you have purchased for its paid term, except where your account is suspended for breach of these Terms.
Online payments. Paid access is billed through the gateways named above. We do not store your full card numbers or bank login credentials. You should complete checkout on a secure connection; payment success and entitlement updates may depend on timely confirmation from the gateway and your device connectivity.
SaaS delivery (no physical goods). CreatorSuite is a software-as-a-service product. After successful payment confirmation, fulfilment is digital and immediate in the ordinary course: we enable the subscription or AI credits and time-based access on your account. There is no physical shipping or tangible good.
Renewals and platform billing. If you subscribe through Google Play, the Apple App Store, or another billing platform, renewal, cancellation, and some billing disputes may be governed by that platform's rules and subscription settings in addition to these Terms.
6. Third-Party Disputes & No Recourse
- Sole Liability: In the event of any legal action between You and any Third Party arising from a document generated by this App, You shall be the sole party liable.
- No Recourse: You explicitly waive any right to seek compensation or contribution from CreatorSuite.
7. AI Unpredictability & Technical Malfunction (CRITICAL)
- No Malicious Intent: You acknowledge that the App is designed with positive intent. However, Artificial Intelligence is inherently probabilistic and may occasionally produce "hallucinations," errors, or unintended outputs ("Misbehavior").
- Assumption of Risk: You accept that any such "misbehavior," omission, or commission by the App is a technical limitation of AI technology, not a malicious act by the Developer.
- Total Waiver: You agree that the Developer shall bear NO LIABILITY for any actions taken by you based on such unintended App behavior. You are solely responsible for verifying all outputs.
8. Refund Policy & Account Suspension
- Termination for Breach: We reserve the right to ban or suspend any account found violating these Terms, including generating illegal content, abusing the referral system, abusing optional promotional or advertising-reward programs (including misuse, automation, or attempts to circumvent fair limits), or attempting to reverse-engineer the platform.
- Effect of Ban: If your account is banned for a violation of these Terms, you forfeit all remaining subscription time and credits.
9. Governing Law, Jurisdiction, and Mandatory Law Carve-Out
These Terms are governed by the laws of India. Subject to applicable mandatory consumer-protection law, the courts at New Delhi, India, shall have exclusive jurisdiction over disputes arising from or related to the Serviceâincluding the App, our websites, payments, subscriptions, generated outputs, credit and bonus programmes, and your use of our software, APIs, hosting, or related technology. Where non-waivable local law grants a consumer the right to file in local forums, that right applies only to the minimum extent required by such law.
10. Policy Version and Regulatory Override
The version of these Terms and the Privacy Policy published here with the stated "Last updated" date generally governs your use from that date forward. Prepaid subscription rights for the paid term you purchased remain as offered for that purchase, except where a change is required for legal, regulatory, security, or fraud-prevention reasons. Later law, regulation, regulator direction, or court order prevails to the extent applicable.
11. Changes to These Terms
We may update these Terms for changes in the Service, technology (including AI and infrastructure), security or abuse, pricing or credits, partners, or legal compliance. We will post updates with a revised "Last updated" date. Material changes may include additional notice when practicable. Unless applicable law requires otherwise, continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service and contact support@creatorsuiteai.org. Changes required for legal compliance, security, or fraud prevention may apply without advance notice where permitted; we will explain where we reasonably can.
12. Acceptable Use Policy
You must not: use the Service illegally; generate or publish unlawful, harassing, hateful, or harmful content or content that sexually exploits minors; probe or break security or evade rate limits, authentication, or payments; use automation to overload the Service or evade fair use without consent; reverse engineer except as permitted by law; resell or pool paid access without permission; misrepresent identity; upload inputs you have no rights to use; abuse referrals, trials, or ad-rewards; publish outputs in breach of platform rules. We may suspend or terminate for breach.
13. Your Responsibilities
Provide accurate account/billing information; safeguard credentials; notify support@creatorsuiteai.org of suspected unauthorised access; use outputs lawfully and review before reliance; do not use payment methods fraudulently; confirm you have rights to inputs; comply with sanctions/export rules applicable to you; understand the Service is delivered digitally (account access and credits), not as a physical product, as described in the Pricing & Subscription Terms.
14. Licence and Permitted Use
We grant a limited, non-exclusive, non-transferable, revocable licence to use the Service per your plan for content creation. No resale or white-labelling. Service is as available. Minimum age 18 (or local age of majority if higher). We may modify or refuse service for violations or risk.
Important: CreatorSuite uses Large Language Models (LLMs) to generate text and scripts.
1. Digital Product Nature
CreatorSuite AI provides non-tangible, irrevocable digital subscriptions. Once a subscription is activated and credits are issued to your account, the product is considered "consumed."
2. Technical Failure & Activation Guarantee
If your payment is successful but the subscription is not activated due to a system error, our first priority is to manually activate your plan within 24 hours of notification. If we are unable to resolve the activation within 5 business days, we will issue a refund of the eligible amount for that payment through the original channel, net of taxes and payment-processor deductions as in section 4 (unless mandatory consumer law requires otherwise).
3. Duplicate Charges
In the event of accidental double-billing for the same period, the second charge will be refunded within 5â7 business days upon verification, typically via the original payment method or as reversed by the payment provider (card, UPI, wallet), subject to bank, network, and processor timelines. The net amount may be less than the duplicate gross charge for the reasons in section 4.
4. Net Refunds: Taxes and Payment-Channel Deductions
Where a refund is due, the amount credited or reversed reflects what can lawfully and practically be recovered through the payment channel. It may be less than the gross price because: (i) government taxes and levies (e.g. GST)âwe follow tax law; amounts non-refundable from authorities may not be passed through; and (ii) gateways, banks, card networks, wallets, or stores (including Google Play or Apple App Store) may retain fees, charges, FX differences, or other deductions we do not control. We do not absorb those deductions except where mandatory law requires. This aligns with common practice for card, UPI, wallet, and in-app purchases, subject to non-waivable consumer rights that may apply to you.
